Assuming thay the information they will share is what all of us are seeking, it is not going to be a bad deal if we can find 500 people willing to chip in for this initiative (I am an optimist guys).

If they are going to give out the information, then it should be ok to pay $5k.

    Questions are:
    a) How soon will the work be finished?
    b) Can they please integrate this request into their processes that they generate the numbers periodically, such that visa bulletins reflect demand appropriately?

Reddog: We discussed enough on this Donor and Freeluncher's. You decided not to pay. Why still keep arguing about it?

Why not you provide free lunch to your neighbor's every day? Over a period of time, those neighbor's will think it is their right to get Free lunch from you.

If you are a student and not earning, you have every right to request for free access. You claim to be Highly educated and earning and you still want free ride?

    This was a smart reply.
People are so used to getting everything for free.

The starter of this thread never did anything all this while and when he has not got his greencard, he thinks he has the right to blame IV for his problems in life.

Is it possible to get an emergency AP 90-days after the renewal application receipt date?

The reason I'm asking is because I would like to purchase airfare now for travel in January .. but am concerned that my AP won't be approved within the 90-day period USCIS mandates.

    Thanks!

Good post. Politics is a game of give and take. One thing legal immigrants should learn is not to distance themseves too much from the cause of illegals. If we support DREAM act, they will support SKIL bill. If we support admission bar repealed or 245(i), they will support higher numeric quotes and not counting of dependents. Think about it, our common goal is the same - to have a fair immigration system, where every desrving person has a chance to come to this country legally and with dignity.

There will be new VB in Oct and many people will get returned 485 at that time.

Dont dream that USCIS will take all July applications.

I think this an interesting discussion in the forum in a long long time. Allow me to jump in.

    1. For those with labor stuck in BEC's, file PERM (2 months) +I-140 Premium Processing (10 days). Get a three years extension and move on to a new job. A new job always involve new challenges and learning is an excellent way to channel your energies. Point being there is a way out of the mess !!!
For others invoke AC-21 in I-485 stages.

    2. Studying is another very good idea. What you study should be your personal decision. Doing MBA, or Acquiring new technical skill at local Universtiy or certifications (CCNA/CCIE/PMP). There are always things to learn and a good way to advance your career without GC.

    3. For non-working spouses there is very little they can do, but Non-Profits is way to start and see if you can get an H1B later from the same or a new employer.

In nutshell you can cope up with this frustration by taking control of things that you can !!! Do not let this mess affect you more that what it should be.
For the rest let's help IV in any way we can. Have a good weekend.

Everbody's posts here are speculations on what USCIS will do ...
Geez.....you definitely need a brain check.

    :D :D :D
Say at USCIS's "mid month" meeting, they are discussing the major points:
<conference call service> badoop! badoop! badoop! badoop!
Dr. Emilio T. Gonzalez, Director: OK, it is 11:30, everyone ready for our morning bi-monthly call?
Jonathan Scharfen, Deputy Director: I'm Here Dr. Emilio!
Dr. Emilio T. Gonzalez: <muffled> I bet you would be brown no....
Lynden Melmed, Chief Counsel: Mr. Melmed, Esq., Present!
    <all>: Yesssss!
    <conference call service> badoop!
Dr. Emilio T. Gonzalez, Director: OK, who is late! Who is it! Speak up!
Jonathan Scharfen, Deputy Director: I think it was Jeffrey! I got a virus last week and he..
Dr. Emilio T. Gonzalez, Director: Enough Jonathan!
Jeffrey Conklin, Chief Information Officer: I'm here. I was just instructing our IT staff how to reboot the talky thingy phone system.
Jonathan Scharfen, Deputy Director: You mean the "V.O.I.P. Call Center."
Jeffrey Conklin, Chief Information Officer: I know I was going to...
Dr. Emilio T. Gonzalez, Director: Enough Jonathan! I'm not inviting you next meeting if you continue this. Lets get started! Now Lynden. You there? What is that status of this class action suit? My girlfriend said I was wearing a "class action suit"!!
    <all> lol!
    <all> lol!
    <all> lol!
Lynden Melmed, Chief Counsel: Well, we umm...
Dr. Emilio T. Gonzalez, Director: Come on Lynden, out with it..
Jonathan Scharfen, Deputy Director: I think that we should counter sue..
    <all> Shut up Jonathan!
Dr. Emilio T. Gonzalez, Director: Lynden! I've had it up to here with your dithering: Out with it man!
Lynden Melmed, Chief Counsel: Ummm... they might have a case sir.
Rendell Jones, Chief Financial Officer: What do you (ahem, this is Rendell) What do you mean a case Lynden?
Lynden Melmed, Chief Counsel: Well, it is just that in order to make our organization a profit center as per Presidential directive #232322, we did a little boo boo.
Rendell Jones, Chief Financial Officer: I want to state here and now that I advised against it!
Dr. Emilio T. Gonzalez, Director: Shut up Rendell!! Lynden! You make those foreigners and their case GO AWAY! That is our job, to make them GO AWAY! Don't you know that that is what we do here? How long have you been here Jones? Not much longer at this rate!!! Rendell! Were do we stand with this. It is July and the board has not finished our bi-annual bonus calculations yet. This smells like trouble. What are you going to do Rendell??? RENDELLLLL???
Rendell Jones, Chief Financial Officer: Umm, well the new schedule kicks in next month. We plan on holding the July applications hostage until we get them paying new rates.
Lynden Melmed, Chief Counsel: Can you do that?
Rendell Jones, Chief Financial Officer: You're the lawyer Lynden! You want your bonus or not???
Lynden Melmed, Chief Counsel: Oh. We,umm can't do that! Is that why we? Oh crap.
Dr. Emilio T. Gonzalez, Director: Rendell!!!! Was this your idea???
Jonathan Scharfen, Deputy Director: Yes it was! I saw the memo! I'll fax it to you if...
Dr. Emilio T. Gonzalez, Director:Jonathan, you're getting staticy, I'm disconnecting you. Call back later!
    <conference call service> <badoop> "Scharfen, Jonathan....Disconnected."
Jeffrey Conklin, Chief Information Officer: There's nothing wrong with the v.o.i.p. system sir!
Dr. Emilio T. Gonzalez, Director: hmmmmph.
Jeffrey Conklin, Chief Information Officer: In fact we're really busy with that call center. Phones are ringing off the hook!
Dr. Emilio T. Gonzalez, Director: As long as they don't get my number!
    <all> lol!

Go_guy when did you come to US, When did you go to Canada (Toronto).Which job are you doing now in Toronto?

I first came in 1999 Fall as MS student. Then in between, I went back to India during the 2002 downturn and then came back in 2005. I did my MBA finance at U of T and now
working as Analyst since my second year ( due to F1 visa restrictions I couldn't have
done that in US). After graduation I am working there but looking for better options as well.

I came as PR in Canada. But i look at the international students from India in U of T. They are far better of than the international students in US. Here they get 3 years work permit
after graduation and can also work part time while studying. With new rules u get PR quickly after 1st year. Also during the 3 year post degree now they are eligible for the government health care like PR/Citizens. Canadian immigration is now highly tailored toward people
    studying/working in Canada.

Compared to that, US treats its international students like dogs. If I get the opportunity to relive, one thing that I would not have taken was doing my previous MS in US. Moving to Canada was the smartest decision taken...no regrets.

There is nothing really called transfer. When you are filing for the first time its counted against the cap. Otherwise its not. So when you are transfering the H1

    1. You are not counted against the cap
    2. Need to prove you are in status.

Yes there is and it is called visa portability. :) this is for you as well piyu, do not jump into summary so fast.

Ok, Here's what law says about so called "transfer"

    D. AC21 105 -- Visa portability
The AC21 105 provides that a nonimmigrant who was previously issued an H-lB visa or provided H-1B nonimmigrant status may begin working for a new H-lB employer as soon as that new employer files a "nonfrivolous" H-lB petition on the nonimmigrant's behalf, if:

    (a) the nonimmigrant was lawfully admitted to the United States;
    (b) the nonfrivolous petition for new employment was filed before the end of their period of authorized stay; and
    (c) the nonimmigrant has not been employed without authorization since his lawful admission to the United States, and before the filing of the nonfrivolous petition.

The status of a dependent of a principal nonimmigrant that is working pursuant to portability benefits is derivative of and linked to the status of the principal nonimmigrant. Therefore, dependents will remain in H-4 status if the principal nonimmigrant is lawfully working pursuant to portability benefits.

    Further it says,

The Service expects, therefore, to propose a rule that would afford H-lB beneficiaries, who are no longer working for the initial H-lB employer, some reasonable period of time such as 60 days after leaving the initial H-lB employer to begin working for a new H-lB petitioning employer under the portability provisions. It is important to note that such a proposed rule would not, of course, take effect until it has been published as a final rule, after notice and comment, and any revisions. This prospective statement of policy is provided solely for informational purposes to Service personnel and shall not be utilized as a standard of adjudication in cases involving portability issues, unless and until promulgation of a final rule implementing AC21 105 with such an interpretation. Service personnel will be notified of any changes in the processing of AC21 benefits that may occur upon the effective date of a final rule.

There are few other memo's on this I will try to post the links for reference

starscream does hae a very valid point, just the dates becoming current doesnt mean we are out of the woods. The dates can retrogress any time and then we might again be stuck in limbo even after we get our 485 application in. We absolutely have to keep going on the CIR front as well.

If your planning to go to Court, then gather the names from every body.

I will contribute my buck and names for this.

It is a little early for that. I was told the lawyers reviewing this case will get back to me shortly. I will let you know as soon as I hear anything.

Let me ask you the opposite question : How does NOT passing CIR help us ?
I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.

And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. Thats just rhetoric from the likes of numbersUSA and lou dobbs blindly being parroted by some morons/idiots/imbeciles here. The core team had repeated this several times when CIR was under discussion. CIR is definitely not ideal for us because of the possibility of collateral effect from USCIS being overwhelmed, but is that worse than our current situation of waiting till retirement for our PDs to become current ?

As rheoretro mentioned in an earlier post "Burning someone else's house down is not going to help us build our own". That is particularly true for us .. those who who are against illegal aliens are also against high skilled legals with a few honorable exceptions like Cornyn and Kyl. If that wasnt the case, the house and the senate would have passed SKIL in a jiffy by now. Its best for us to remain neutral on the illegal alien issue .. and back it to the extent that it benefits us through a piggy back ride.

How does passing CIR help us? I didn't really have the energy to go thru the whole bill but it didn't specify what "line" those 20+million ppl who eventually get amnesty will be processed in. If they line up on EB3 or a supplementary bill in the future decides to allocate some EB3 to a "Schedule B" (just for example), then we are right back to where we started (but add more years to the waiting).
