Ya, I am thinking of starting an outsourcing company which could take this stupid easy work from USCIS and outsource all that work to Thailand. Then I will sponsor work visa for all these bumps at USCIS to work in the outsourced site. Soon you will see me in the court of loo doggs answering his question "how in the world did you outsource all these 'american' jobs"? And my answer would be 'because these guys were all genius and were expert at eastimating the cost of running a query. So we hired bunch of them to represent the company with USCIS."

I think I know how this works. They would outsource this program to some govt contractor (or ask the govt contractor who is working on their data ) to produce that report which costs (<10$ worth of time/effort, if they have all the data).
If all they want is money ..so be it. I am ready to pony up $50 for this,if we all approach together. But as someone suggested country of chargability is a must.

Who said EB3 India will not forward next year? Did DOS say that? An individual lawyer is not Dept. Of State. I would like to see a written proof from DOS saying this so that we can plan ahead.
There were many naysayers for the July 2007 bulletin. But IV was able to get it current again. So stop believing in predictions and believe in yourself.

Pappu, I bet you must be in a better position than me to know (not to decide, ofcourse) about the plight of this bill. I would be surprised if you deny.

The good news: the CIS backlog isn't as big as previously feared and their productivity is at an all time high;
More good news: China EB3 had almost caught up with worldwide EB3 and is likely to do so next year;
The bad news: when visa numbers become available again, India EB3 is going to be back where it was almost a year ago and it is not likely to move forward much in the next fiscal year.
More bad news: 40% to 45% of the entire backlog is Indian EB2 and EB3.
And barring, July 2007, EB3 I has moved only inches in the last 2-3 years and that's how much it would move in the next 2-3 years (and that's assuming a similar efficiency pattern that USCIS exhibited this year).
I am not trying to open a new can of worms here but reminding of an old one that is already existing - EB3 India. The most priviliged to remain in this god damn queue for as long as they wish and even beyond that.

I see a lot of boiling blood and nice thoughts, If we can find out How much it would cost to pull out a Half page or Full Page AD on prominent news paper like NY Times or WSJ etc. Work on and create a fullpage/half page ad that would be a good start in opening eyes of congress/common people.

Sorry, I don't agree with you and also my mistake that I am linking my perm labor filing with Larrabee. I agree my perm labor is delayed because of my company.
But I have seen Larrabee handling my h1B transfer case where they screw up by missing some document. Atleast by my experience I wound not suggest my company and Larrabee as well for any immigration stuff
all our h1's transfers perm 140 got processed smoothly with larrabee...they worked all of friday and saturday to file 485's to reach by monday
it all boils down to which attorney handles your case?

I spoke to a woman in the USCIS customer service and she doesnt know Jack. All she told was there wont be any further authorizations starting from June 02(as idf we dont know this. Teh whole world knows). They will put all the applicatiosn received on July 02 in hold and may start processing from Oc 01 2007. As i said earlier she knows jack about the probelm. If you ask more questions they simply say that they are only customer service and this is what they know. I asked who else should i contact to get more info and she told i have to contact them only. What an idiotic organization.

Many of us who visit IV forums everyday know that snethil1 is an idiot. I would highly recommend more people to add him to your ignore list, just as I did. I read his post because you quoted him in your post. Otherwise his posts do not even show up on my screen. He and his posts are inconsequential if you add him to your ignore list.

How you can impress Senate or house? But anti immigrants gave all the layoff numbers, h1b numbers used and details of abuses happened for past few years. It is not just money power will win. With facts and numbers if you have money power then you can win. That is reason for past 3 years H1b numbers or GC numbers were not increased inspite of heavy lobbying.

ask a EB3 person if he was happy when EB3 was available and Eb2 was not.
Did any one try to justify the reason why EB2 was UNAVAILABLE? No.
Did anyone here feel unhappy that EB2 moved so nicely? No.
Then why are we not seeing a single post from anyone which says we as aspiring immigrants are not being failrly dealt with when EB3 did not move with EB2.
Instead we see posts about why EB3 is not moving and explanation of reasons behind it.
Is there a hidden agenda here, NO. Not from IV, am i trying to prove something like that? I dont think so.

Guys, let me say something here.
$5000 for one query is not an unfair amount of money. The reason I say this is because I know a thing or two about writing quality queries, I have done that for the last 6 years of my 9 year career querying the heck out of Oracle CRM.
It does take time to write queries and the time it takes depends on how many pieces of information you want to bring together. The wider your spreadsheet is for the final output, the more islands of data need to be connected to fetch that output. Those who are familiar with SQL would know that I am talking about going thru potentially 20-25 tables and joining them to get data. This is probably not going to be a select * from 485_cases kind of query. If it takes 100 hours of time to write such a query, at $50 per hour of programming time, it could be 5000. Most likely it may be fewer hours if they have a programmer with knowledge on staff.
The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.
And on that note, thanks to "Needhelp!" for shining some light on USCIS process thru her FOIA.

Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.
P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)
Wow! I know someone just like you. She has been cribbing, crying and cursing because I have a 2005 PD and she has a 2004 PD and we are filing 485 together. The sad part is she is able to file 485 and her jealously is because we are doing it together. She says she should be much ahead of me by now :) :D

I am very glad that you brought this point. Nothing would give me greater pleasure than suing the DOL. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let�s get IV�s attention and support in this area. Let�s talk to AILA. Let�s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let�s write to media personnel. Let�s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.
I would strongly suggest talking personally to IV leaders about this. These are folks who by now really have a feel about how things are handled out there. They will suggest the best way to tackle this issue and am sure with their mature guidance, this is a very simple techinical issue that can be resolved. You are literally just saying "SIR, I WAS HERE BEFORE. I KNOW YOU ARE BUSY AND POSSIBLY FAILED TO NOTICE ME, BUT HERE I AM, AND I HAVE BEEN WAITING FOR LONG TO GET YOUR ATTENTION". honestly I dont think even USCIS wants to hurt you purposely, its just that the traffic of new PERM thing has overcrowded their desk and mind so they have shelved your applications unknowingly. PLEASE SHOUT OUT----THROUGH IV ONLY. let them realize that we have a strong organization and ONLY ONE STRONG ORGANIZATION.

I was told by my attorney NOT to do this...Apply either through yourself or through your spouse. I was told that if there are two different applications for the same person, then it raises a red flag and you might end up in a big soup...But having said that, your attorney(s) might have different opinion(s)...
With the good news of all numbers current, both I and my wife's dates are current and eligible for filing I485.
1. In my application, can I include my wife as spouse for adjustment of status? And In my wife's application, can I include myself as spouse?
I am trying to do this to make sure if anything goes wrong in any one of our application, I can depend on the other one.
2. If I get an EAD based on my wife's application, can we both switch jobs after 180 days and take advantage of AC21? I read in some forums that I can, but the primary application (my wife) has to work for the same company until we get I485 approved.
