    You are right but unfortunately history has thought us that when it comes down to GC versus H1b everybody is willing to throw GC under the bus to get H1b provisions.

    This current bill is no exception, h1 increased from 65,000 to 115000 with triggers to increse it to 185000, but no provisions for green cards.

    a exclusive emendment with GC will be the only way out. nobody is offering such amendment and if somebody offers it might be ordered to lie on table.

    Text of almost all filed amendments is available in congressional record on Thomas. This one has been available since Friday.

    It creates a parallel merit-based employer sponsored category without touching the existing merit-based self-sponsored category.

    The merit based self-sponsored category is the crappy points system. This is in parallel to that, without touching anything in points system. They have created an exact parallel replica of today's EB1, EB2 and EB3 system with labor certification and the whole enchilada where you need employer sponsor and there is not points or anything.

    EB1 = 33.3%, EB2 = 33.3% and EB3 = 33.3%. Definiation of EB1, EB2 and EB3 would be the same as it is today.
    Total quota of 140,000 with automatic recapture of previous years unused GCs.
    Exemptions for US masters and non-US STEM masters with have 3 years experience in that STEM field.The risk factor:

    Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.

    The exact same radioactive provision for H1 quota is also in Lieberman-Hagel amendment 1242.

    This will sink both of them unless either there is some inside deal going on that we dont know, or they strike out the H1 issue from this on the floor of the senate at the last minute and be content with H1 quota of 180,000.

    I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?

    No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.

    India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

    I have much better lifestyle and opportunities than Canada or even western europe! Period.

    If this government doesn't wake up and solve this problem in a year or so, I don't think, this country deserves me, or for that matter any graduate degree holder.

    Better off utlizing the skills I have acquired here, and spending my next 5-10 years contributing to India's economy. Maybe start a company or something...create jobs out there, and then as and when the laws straighten and America becomes welcoming to EB talent, think of coming back (if ever....)

    We cannot compare EB and point system now. Only point system comes we will know the problems

    But there are problems with the point system that have been foreseen and articulated right before it starts. Compare that with the EB system which has sound underlying principles and has worked fairly well. The backlogs and process delays in the EB system have resulted from

    1. A lack of funding for past legalization initiatives (245(i) amnesties) AND
    2. A lack of employment based green card numbers AND
    3. The 7% country quota

    The point system proposed in the CIR system does not address any of these 3 points, plus it is not spelt out how they would deal with the situation where a few countries submit greater than 10% of the applications with high points (what we call retrogression today).

    For openers, let me be totally honest. By obtaining a visa from the US government, you have _explicitly_ agreed to abide by the rules set by the US government. To claim that they are somehow "unfair" or "discriminatory", especially after you have agreed to them, implies, IMHO, that you had no intention of abiding by them when you accepted the visa.

    During my career, I have investigated opportunities to work in a few other countries and have consistently found that they had significant barriers to a US citizen coming into the country to "take jobs from their citizens". While I might have enjoyed working, for instance, in the UK or Australia, I also accepted that their governments had the right to set their own "house rules". I guess, though, it may be too much to ask to expect similar consideration for the US government's right to set _its_ own "house rules," no matter how quirky they may seem to others.

    As for the comparison of which visa holders' spouses/dependents can or cannot work here, I would ask the unasked question, "Why not allign these variances in the visas in the OTHER direction?" (I.e., why not simply change things so that NO spouse or dependent who obtained their visa based upon a primary visa holder is permitted a work-visa?) I realize this is probably not a popular position in this forum but, if for no other reason than being the "Devil's Advocate", perhaps it should be raised and considered. :)

    My law firm, Greenberg Traurig has been good too. Their immigration practice worked extremely hard to get the applications in-flight on Saturday. May be bcose they did not have 1000s of cases like other immigration law firms.

    I dont think this bill has or will have any favorable provisions for us unless a miracle occurs.

    I think the tech companies have cut a deal with the Senators through which they will have access to 115,000 H1Bs and more moving forward inlieu of no increase in EB green cards.

    Here I will summarize why we are unable to work with each another


    Agreed 100% Porters will eat everything, there will be no movement.

    By this and a later post MC is showing openly brazen attitude toward EB3 applicants. Such posts should be first of all, banned from IV and I am going to report all such posts.

    Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(

    You wouldn't show this :( expression if it were YOUR hibernating application. Also see if Mr. Nathan's comment below would apply to you

    When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.

    I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.

    BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3

    This is the brazen post I was talking about earlier. Even MC himself acknowledges that this post is "unhelpful", and he is deliberately doing this. This gives a negative impression of how serious this person is. I would urge him to buck up and learn to work with everyone, and quit watching "balance" from his sole viewpoint

    I have done some study and can understand not many are porting. But there are few.
    But if we raise our voice against porting, they will raise theirs with double the intensity against spillovers. So I dont think we should throw stones on their houses, when ours are made of glass. Moreoever if we see the statistics, there is a HUGE # of EB2 applicants in 2007 onwards I think. Unless we all act together, its not going anywhere.
    I know many cases where newer applicants applied in EB2 and were much lesser in hierarchy than their bosses who are in EB3 and waiting. I think we must respect that, and more importantly as soon as raise our voice, they will not keep quite, right. You would also not keep quite if in their shoes.
    Best will be if IV comes up with some programs to reduce this backlogs.

    This is an "us vs them" argument. Not upto the standard desirable from IV point of view

    People with EB3 applications should be allowed to port. But these should be EB3 applications which were genuinely applied and not substitute labor which opened during July 2007 fiasco.

    Because a EB3 application with substitute labor in July 2007 has a priority date of 2002,2003,2004,2005 or even 2006. Where as a genuinely applied Eb2 prior to that, had the qualifications / job requirements before July 2007 and they are still waiting.

    USCIS should realize their mistake in 2007, it encouraged a pay to play scheme, which is putting genuine people at great disadvantage.

    Porting like any option was started with a good intention, but because of loop holes it has lost its meaning. There are people who landed in this country during the July 2007 fiasco, paid for the labor and have green cards in their hands now.

    Or at least provide the same level of stringent requirements to port like (EB2-->EB1) . Technically a EB3 can port to EB1 also, but porting to EB2 is easier. That way Eb3's can consume Eb1 number and stop spill over to Eb2.

    L1A is another one, where people qualify as global project managers with very minimal effort, could have less experience than a EB3 or in some cases they have reported to people in EB3 queue here from 2002 and are ahead of the EB3 within 6 months.

    Understand the realities here: IV is struggling to make even the most legitimate views heard and you are sitting and talking away as if USCIS and lawmakers are your servant. Go for the ONE thing to wish for that will solve all troubles, because you have only one chance.

    You wont talk about this crap/crab if you are on the receiving end.

    The CRAB STORY also applies to EB3. Whenever somebody talks about spillover to EB2, all the EB3s are against spillover and making comments that it's not happening this year. It feels like EB3s do not want EB2s to get GCs. If porting is legit, then spillover is also legit and EB3s need to accept that.

    Porting was always there and porting must not be more than 300/quarter this year (other wise EB2 PD dates would have retrogressed or gone back). Porting was not something started in FY2011 or FY2010. However, I do accept that the frequency of EB3-EB2 porting has increased slightly due to more US companies outsourcing IT jobs (bad economy -> more outsourcing to reduce costs{check the stock of CTSH!} -> demand for consultants -> resulting in firms like CTSH and small consulting companies agreeing to EB3-EB2 porting to keep talent). Outsourcing will not always result in all the US jobs to completely move to outsourced countries (I guess smart people in this forum already know that).

    There will be spillover this year and EB2 PD reaching DEC 2006 by end of FY2011 is a real possiblity. There is no need for EB2s to get all worked up when somebody ports or EB3s to get worked up when somebody talks about spillover. There is GC pie for everybody. Just be patient or do something to solve fundamental problems with GC process ( by participating in IV campaign).

    I do not see any issue here at all. Most of the housewives (including mine) and sons/daughter take EAD/AP and do not work. EAD is just an authorization, not a compulsion to work. Being legal here stems from the fact that her petition to adjust status (I485) is pending for decision from USCIS.

    I've been having sleepless nights ever since a cut off date of May 15th got in the fray.
    Here's my case -
    I140 sent to USCIS on June 06th (They should have received it on June 07th)
    I have not reveived a receipt date yet.

    What would the receipt date for my application be -
    June 7th when USCIS receives the application
    or
    Some later date when my application goes into the system
    Now assuming that a new cut off date of June 19th is established, would my I140 be treated as pending on June 19th? Or only those applications will be treated as pending that have a receipt date prior to June 19th.
    Gurus please enlighten and help me sleep.

    Tell me about it. My I 140 was couriered on May 21st (reached on May 22nd) after I submitted everything on Mar 16th to my lawyer. It was very painful to read that bill text and figure out that all the time spent waiting on labor cert for the past 3 years has gone to /dev/null. Have you filed under PP or regular processing? I have done mine under PP and its approved now. All notice of actions will have two dates
    1) Receipt date
    2) Receipt notice date

    Its difficult to predict which one will they pick. We are better off with the first one. My H1 which was received on Jan 4th 07 had a receipt notice date of Jan 10th 07 under normal processing. Give heads up to your lawyer to support your case if the bill is enacted into law. They can possibly argue on the basis of the Fedex/DHL receipt or receipt date itself, as your receipt notice date happens to be after Jun 19th 07. I hope that this bill dies again in the senate and the house forces the senate to break CIR into small pieces. Teddy in senate will be playing spoil sport, if at all that happens.

    Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

    Everyone show attitude towards desi. Travel London, Frankfort, Amsterdam, Paris, Zurich, Dubai, Baharain anywhere so I prefer nonstop. I can live with lazy airhosteses in Air India or Continental over seperzelous security in Europe or Middle East.


    my opinion:

    AI : I love my india , but will not fly AI , because I dont want to take chances with once a year vacation I get.

    BA : They are prompt service folks , but I cant tolerate their attitude.

    Luftansa: Again good, but cant take the attitude.

    cathay/singapore/korean/Arab emirates: Nice , can bet my time and money for my travel on them

    Others : I dont really care.
