as long as they can cash the checks.
the law has not changed, no one can presume what will happen
it's just that we are the fools in this, spending thousands of dollars without any choice in the matter, and then in one sweep all of it will be laid waste and we will be starting again...
what's more, for the indians among us, with the merit system, when with 90 points on board you will have no assurance of ever getting a green card.

First THANKS to all for the fantastic information and help on this forum !
I have a H1 B based on IT ( Software Engineer).
I have already completed 6 years in the US, but I have three year extension till 2010 based on my labour pending for over 1 year.
I am not very keen about Green Card - But I wanted to change my job to Marketing for an insurance company (better pay and it is a role I like).
My questions are :
1) Can I transfer my H1 to do Markeing for the insurance company ( the job profiles are going to be different as my current job is in software) ?
2) Since I am on a three year extension based on my current Labor will it be an issue to transfer to the new company ? ( The new company is willing to transfer but is not willing to file a new H1).
Your advice is much appreciated.

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
I had a similar experience in 2004 when I took Air France for the first time (to Delhi, connecting at Paris). It was the last time I ever took Air France.

Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

This is essentially what we got in July07, and this can be a great pain relief. Since it was done in July07, there is already a precedent for it?? Would it be an administrative fix then? Just a note , IV already has this as one of the things we are working to change in law, but I was wondering if it could be admin only fix.
This is different from what was done in July 2007. Back then all PD was current. This is to grant the ability to file AOS even when the PD is NOT current

Congratulations and enjoy your green card! Don't worry about the priority dates not being current when yours was approved. My green card was approved in September 2007, sometime after the July fiasco wherein the PD for all categories became unavailable. Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

Nope. Need 60 votes to do anything in Senate and that is why even though the Dems have a so called majority then cant get anything done.
However, you need 60 votes to end a fillibuster. A fillibuster is the method used by senators to stall a bill. They will force debate to continue indefinitely. To overcome the forced debate, you need 60 votes (which is what the cloture motion is).
To pass the bill, only 51 votes are needed. If there is a tie (50-50 or 49-49 or any valid combination), the the Vice President casts his vote to break the tie (and we all know on which side the VP is on)

I never heard about I-140 substitution. Are you sure your employer request USCIS to change the name of the beneficiary on the approved I-140?
As far as I know I-140 is the petition by an Employer for an individual Employee, so it goes with 1 person and can not be substitute.
Employer can revoke I-140 or use the underlying labor for some other individual.
It may have been the case that USCIS by mistake approved 2 I-140 for the same labor and when they realise their mistake they denied your I-485 suggesting someone else already used the underlying Labor certification.
I guess your original employer as well as USCIS are at fault. I dont think AC-21 provisions will help you either, bcos the USCIS rule is 1 beneficiary for 1 labor, their can not be multiple beneficiaries for 1 approved Labor.
Please consult your situation with the experienced attorney and see if you can file MTR, since its not your fault and you are suffering due to USCIS/Employer mistakes for using 1 labor for 2 I-140 approvals.

In 2005, a special 50K quota was carved out for Sch A. Now they're talking about another 90K quota exclusively for Sch A.
Where did the 50K visas come from? Where will the 90K visas come from?
Are they from the total pool of 144K/year or is this an additional amount (144K + 90K) allocated for health care?

I fully agree.
They may have some material education.
But Indian guys working here are third class fellows.
Arrogant, low tendencies, flase values etc.
They don't even mix with other Indians and think they are in Heaven or some thing.Don't worry if they loose their GCc.
These guys are unworthy of gettings GCs.

Here is my take on usabal, the firm is well known in the Bay Area, so if you are in that area, you are ok.
For TX, they acquired the firm Jenkens and Gilchrist last year. Jenkens attorneys are very conservative, and if you happen to work for a big employer who has hired Berry, Appleman... you are screwed.
They may still work out ok for you on an individual basis, I would stay away from their TX office for sure.
Berry, Appleman & Leiden LLP is very good firm. I have very good experience with them. They completed all my paper work on Jun 30, so that they can file by July 2. Also the attorney and the para-legal were really good and replied to my questions patiently. The website is http://www.usabal.com/

Air India has the newest Boeing 777 LR non stop from JFK to Mumbai and Delhi. You can get tickets as cheap as 1000 usd roundtrip in economy.
Cheapest business class where you can SLEEP! 3500 USD roundtrip to India. Find a cheaper business class where you can actually sleep and let me know.
Best food! undoubtedly. New entertainment system with lots of Indian movie options.
I am not sure if old sayings apply to Air India.
Also we have jet airways , whose international service is in same class as singapore airlines, emirates and virgin atlantic.
So why are we wasting time with such moronic european airliners? who cant let us sleep one night in their country.
This year, I flew Lufthansa as that was the most viable option for me. The flight from Germany to Mumbai was substandard but the service was ok, cant complain. People were friendly at the german airport.
In 2004 or 05, I flew air france one way on reward ticket, the FAs were rude to Indian customers but overall flight experience was smooth , comfortable and without hassle. People at french airport were ok.
The lufthansa ticket was 1640 rountrip. I also considered air france, first they quoted me 2200 USD and then said, if I could compromise and flew alternate dates, fare would be 1840. The ticket agent sounded as if he was doing me a favour. No wonder when I showed up at the airport, the air farnce flight was almost empty whereas there was a big rush on lufthansa.
CHANDU - I see airline is responsible for this. It is their duty to prevail on authorities otherwise why are they asking for business from Indian customers? In 2004 Delta used to fly via france and my brother had missed connection, he was provided hotel by delta in france for one night. Good that delta got fed up with european visa rules and started new non stop service.

It is very easy to write but difficult to do. Except for IV folks there are hardly any fighters out there for our cause. We have all seen the result....CIR that favors ill-legals but decreases visa numbers for the EB cases.
