Do not depend the processing of your papers entirely to the lawyer or their paralegal. Be proactive. Always demand a copy of the application prior to the actual filing. You will be shocked to see so many errors. It's also good to check IV news once in a while. If it wasn't for IV updates, our company would not have been able to correct our lawyer's mistake in filing for my H1 extension. He insisted that USCIS never grant a 3-year extension even if I-140 approved. I showed him IV success stories and he apologize for his error.
Remember, lawyers look at their clients as $$$. The more services they can create, the more $$$ they can get.

First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.
Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.
It will be great help for me if you could refer a kit or a consultant.
Looking forward to join H1->Canada community :D

With Sen. Pelosi in charge of the House, you can expect a leverage for sure. More corrupt than ever, a Democrat powered senate should push hard for illegal alien amnesty. If you are lucky enough to get your case processed before those 20 million+ people, yes, that can work well.
I agree 100% with you. If you do not get your GC approved before those 25+ million people get in the line ahead of you. Remember they will have to send those 25 million names for namecheck and the government will do theirs before everybody else's.

No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.
India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.

Going back to India is not a bad option at all, but it is really subjective to each individuals about what gain we are going to get out of gaining GC or citizenship from US or Canada like settling down in these countries for good or moving back to country of origin later. In my opinion gaining citizenship from US or Canada before going back to India will be always advantageous, one future perspective these countries have bilateral agreements with other developed nations where you can travel without visa for business trip or for even jobs where you're treated differently as against India citizens(Asian origins doctors who work in UK know this difference). Its a known fact that the pay structure in Gulf countries are different based on the citizenship.

So, 80K LCs a year, 10%-15% of them will probably never get to AOS stage, 20% of those were duplicates (for people with petitions stuck in the backlog centers), so we are talking about 50-55K new labor certificates each year that will result in I-485. This is very consistent with 85K new capped H1Bs plus whatever number of exempt (non-profit research) H1Bs every year. So, we are talking about 100-110K total AOS applications (with dependents). Now lets take 140,000 EBs, substract Schedule A and EB1 (no need for LC), and there is probably 10K extra EB visas should be left over each year (quota less new potential EB petitions). Those are probably going to land in EB3 ROW. That means the retrogression will become less severe. What we are experiencing right now, is the rabbit that moves through the snake - the EB petitions resulting from a higher H1 cap several years ago.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

You can get labor certification which would satisfy EB2 class requirements and apply under EB3 for I140 .... but not the other way around. ...
That means starting from scratch with PERM with a new Labor... loosing PD and back to square one ... obviously not worth it

My wife and me are coming all the way from Seattle. We are so proud to be part of the Rally. After being a victim of back log center, retrogression, filing 485 was a relief. However there are long ways to go, we think about the the people who are just filing the labor, people who are still stuck in backlog centers, and probably our 485 application who knows may be stuck in name check, the whole GC process is flawed. I have been a member a long time, now I get to meet all of you! I appreciate each of you guys who volunteer and spend selfless hours in support of a cause that is critical for anyone aspiring to be a legal permanent resident! The best way to thank everyone is to SHOW UP!

By AF. It was an OK experience, except for the fact that they loot you on the transit visa fee. Also CDG airport has got to be the busiest but one of the worst airports in Europe. My baggage landed in Mumbai instead of New Delhi, but was sent to me by courier in 2 days time.
Also don't ask a second time for the I-94 form, as the stewardess will frown and shove it in your face. :p
Next time I shall pony up the additional fare for Thai, Singapore or Malaysian and never flying a European route again.

Sc3 and other friends. Here is what has triggered this bad blood on the forum
Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything
The DOS algorithm to allocate unalloted Visas in the last quarter has so far been inconsistent. In previous years it favored EB3 and now it is totally skewed in favour of EB2 . From the deposition of the DOS @ congress they think that this year's algorithm will be the model for years to come.
Now , obviously that is great for EB2 because EB2 will get the lion share/complete share of the spillover . But death knell for EB3.
EB3 will not get anymore ~3000 visas every year till EB2 becomes current.
This will starve EB3 badly , EB2 will be current most of the time and EB3 will in 2001-02 time frame. There is a possibility that 2008 EB2 filers might GC ahead of 2003 EB3 filers.
Starving any particular queue badly does not help the throughput of any system .
I hope DOS will realise this and change their algorithm accordingly.
Each countries quota is equally divided among all EB categories, IMO, The spill overs also should be equally divided among all the EB categories.

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
IF the U.S Master's exception goes through, its pretty obvious that the DOS will tighten the screws on F1 Visa approvals by a magnitude of 100(unless F1 is made a dual intent visa... and that's like asking for the sky), and also USCIS will make in close to impossible to change non-immigrant visas status to F1( from say H1B). So it’s more than the 20K to get ahead of the line. The only benefit will be for folks already with a U.S Master's or it will be a new rat hole, fighting the Consulates/USCIS for F1 status.

Instead of thanking God that he gave him the ability to speak "Man" started arguing with each other about whose language is better. God took him to a room full of deaf and dumb and showed him what the "other" option was if he is not satisfied with what he has now......
Man quickly appeared to realize the mistake in his thought and apologized to God. God smiled and sent him back knowing fully that "Man" had not understood a crap about what he really wanted to show him.
And trully enough as soon as he got back he started to get back into the argument of which was the "best language".
