Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

I have seen your post and also read the links and what i would appreciate knowing is in what way does dream act impact legal immigration advocacy by IV. I mean are they both not seperate entities and will not IV's entertainement of any discussion on dream act dilute the agenda of IV

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Pro...viceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

If you resigned, then I dont think company is liable for any severance. I work for a bank and they have a policy that they consider attrition due to visa issues (like unable to extend H1 etc) as termination for employment. They pay severance only for displacements which happens due to lay offs. I may be wrong and policy might be different in your company but just my 2 cents.

Hello All;
I would like to share our expereience during finger printing apointment at said center. We arrived an hour and half earlier, so asked the security guard if that was OK. She told us it's fine and we should go to lady officer at next door to take application forms. We took for each one of us, filled them while watching "Baby's day out" movie being shown. Returned the applications and were asked to go to assigned waiting seats. Here we were further escorted by an officer to finger printing machine. Did finger printing and had the notice form stamped, and were out of center in less than 30 minutes. No problems, no delays nothing to worry at all. So go and have fun!:D
P.S : Don't drop off your wife at center ... wait for few minutes. Otherwise she would be begging for phone to call you ( as they won't allow her to keep phone). I helped out one such fine lady earlier today!

New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

I did not find much information about this subject here. That is the reason for this post.
Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.

October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. Our friendly anti Jack has provided in the comments a couple of links to an intriguing story regarding Republican National Committee Chairman Michael Steele (currently embroiled in another scandal - this time involving strippers and GOP money - oy!).
