No. OPT means in F1. As long as you register for enough credits, your status continues. The enough credits is determined by your international advisor.

Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

You can show/do non-payed or volunteer work on your OPT to avoid the 90 day unemployed restriction.

Your friend's wife should be okay. As long as the marriage took place before his I-485 approval he can add his spouse for an AOS or follow to join application even after the approval(within limited time window, of course).
In this case the application was sent before the approval so there should be no problem.

I need to apply for AP.
I am in I-485 pending status. Could some one give clarification for the following questions on I-131 doc.
Part I. Information about you
3. Class of admission (is this correct?)
Ex: H1B/H4
Part 3. Processing Information
4. Have you ever been issued a reentry pertmit or Refugee Travel document?
I am in AOS status(I-485 pending). I got twice Travel Document (AP) approved so for.
There is no mention of AP in this question. what should I answer for this question.

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

It depends upon your luck with AP. Because you never know when they will be approving your AP and in case it is lost in Mail (it happens to lot of people) and you need to re-apply with fees again. This is very tricky....... You may get it in few weeks or few months or never. Not to discourage you, it really how lucky you are. All the best. I always will file 3-4 months in advance.

Can this event set a precedent for Western Immigration programs to treat people fairly ?
A similar thing had happened in the past when Canadian Immigration Agency increased the eligibility pass mark. Six months later a court ruled that they have to accomodate those who are already in the system.
I wonder if this open a judicial precedent for unjust affect of 245(i) on all of us. Interesting enough, UK skilled immigrants also have something similar to immigration voice.

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.
They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.
- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?
Can somebody please help by sharing their experience if they are/were in a similar situation.
