I think if you are out of the country for 1 year u can get 3 yr extension. But you would get counted in the quota though,fresh H1, I think.

Dear Attorney,
I am on L1B visa and valid until Oct2010; I somehow decide to apply for green card with certain personal reason.
As I understanding, the employer will file the green card petition for me. I'd like to what's the difference between filing from lawyer ("Duration"), because I am ready to hire a lawyer to file that for myself if it can shorten the duration to obtain a green card. What's the time range it will be processed from L1B to greencard?
My only concern is if it is a shortcut (duration) to file green card petition from lawyer instead of employer.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.

Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

My company allows me to DIY my h1b renewal for my 2nd 3-year term of H1b. My title changed to SENIOR research engineer from research engineer last year. I have the same duty. When I fill out LCA/I129, which should I choose from:
a. New employment:
b. Continuation of previously approved employment without change with the same employer
c. Change in previously approved employment
d. New concurrent employment
e. Change in employer
f. Amended petition
My wage is ok. Are there any potential problems or things I need to pay attention if I file my H1b extension with new title? or it is perfectly ok?

My friend's 485 is pending with CIS and he is working on EAD. He currently does not hold any other visa. In fact his last H1 expired more than a year ago. We recently tried to renew his EAD online on USCIS website. However, we were stumped by a question which asks the applicant about his/her current immigration status in US. It was a drop down box and had many options like H1, L1 etc, but there was no option for somebody like him whose current status is just "AOS pending".
How do we get around this? Do you think it is best to apply on paper?

I am not sure if I am posting it in the right forum. So please excuse me if not. My cousin have some immigration case going on in San antonia, Texas court. She lives in California. Her court date is on 30th July in texas. I need help to find a good immigration lawyer for her. Could you guys please suggest me immgration lawyer (if possible Indian) there, so that I could contact asap. TIA.

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

My parents I94 is expiring on March 27th 2008.
We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.
