USCIS has once again updated its announcement regarding the number of H-1B petitions received and counted towards the H-1B cap. As of May 4, USCIS has received approximately 45,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. As such, USCIS continues to accept petitions subject to the general cap. Additionally, that USCIS has received approximately 20,000 petitions for aliens with advanced degrees remains unchanged. As such, the Service continues to accept advanced degree petitions as experience dictates that not all such petitions are approvable. USCIS will continue to provide regular updates on the processing of FY2010 H-1B petitions. For additional...

Since the early days of this blog, I've chastised immigration bureaucrats who use specious reasoning to treat small businesses petitioning for employment-related immigration benefits more harshly than their large-cap counterparts. The latest assault on fairness and reason is reflected in a trend affecting several categories of employment-based visas -- the H-1B (Worker in a Specialty Occupation), the L-1 nonimmigrant (Intracompany-Transferee Manager or Executive) and the EB1-3 (Multinational Manager or Executive). An example of this trend is a recently released EB1-3 decision (decided May 1, 2009) of the USCIS Administrative Appeals Office (AAO) denying an immigrant visa petition for a multinational...

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.
Thanks for your help.
Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

What is the point of publishing dates for people to see if they have no relevance?
If they are just for CIS employees to see... why publish them publicly and confuse the deuce out of the entire immigrant community?
If they are "a statement of goals", why aren't these goals being adhered to?
Why set and publish goals that are are not followed?

On August 20, John Morton, the Assistant Secretary of the U.S. Immigration and Customs Enforcement (ICE), released a memorandum entitled "Guidance Regarding the Handling of Removal Proceedings of Aliens with Pending or Approved Application or Petitions". The memorandum applies to persons in removal proceedings who meet the following criteria: The alien must be the subject of an application or petition with USCISto include a current priority date, if required, for adjustment of status; The alien appears eligible for relief as a matter of law and in the exercise of discretion; The alien must present a completed "Application to Register Permanent...

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. [Hat tip to reader LAFR for this link].

Amid all the pre-election hurling this week of vituperative, partisan accusations over a Federal Court's partial injunction against AZ SB 1070 (Arizona's foray into federal immigration enforcement), you would be forgiven if you overlooked two small but significant creatures in the immigration ecosystem. A pair of remedial immigration bills, passed by the Senate Judiciary Committee, await a vote in the Senate. Their significance is not merely because they are examples of a rara avis -- that nearly extinct form of billmaking distinctive for its bipartisan features. Nor are they significant for the hopeful promise suggested by their titles -- The...

Guys,
My company in-house lawyer says that i don't have to file for H1-b right now because I was approved for H1-b before. I only use 3 month of H1-b time and changed the status to F1. Now, the lawyer advise me that we should use all of my OPT time and file for COS for previous H1-B in June starting date of January 2009, when my OPT expires.
My question is
1) Do you think it is a good ideas or just apply April 1st 2008?
2) Does anybody else have/had a similar situation, do you guys mind sharing what you did?
I will really appreciate all you guys.
Kudos to all the experts...

House Intelligence commt has nothing to do with immigration. How he votes or other people vote on immigration bills has nothing to do with the fact that they are in the intelligence committee.

October is usually a month where we see improvements as new visa numbers become available for a new fiscal year. Most categories showed forward movement though few jumps of more than a few months. The exception is the Mexico Family 1st category which jumps a year and a half. EB-3 is available again, but not set at a date particularly close. Most people will not be happy with the dates. Here are the numbers showing comparison to the September Visa Bulletin: Family 1st - Advancement of worldwide, China and India numbers by nine weeks to 22 JUL 2003. Mexico jumps...
