I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

USCIS has announced revised filing instructions for numerous petitions, including its Form I-140 (Immigrant Petition for Alien Worker), Form I-130 (Petition for Alien Relative), and Form I-539 (Application to Extend/Change Non-Immigrant Status). The new forms instruct petitioners to file their applications at USCIS Lockbox facilities rather than at USCIS Service Centers.

Short term disability usually is not considered a Public Charge. This is because they are usually carried by private insurance or state agencies and not federal ones. However, I would check if one can claim SDI under CA law if one is not a Permanent Resident or a U.S. Citizen.

My LD 01/31/2003 I485 date 10/20/03 extending my EAD 4th time. Stuck in backlog center TX. Any one recently got from TX backlog?
You are extending your 4 th EAD and here we are fighting for the first EADeven our days are current ( of course changed them back) ....Be happy with where you are and contribute ..please dont start a new thread unless its a uniique issue

As per latest Faqs from USCIS interim EAD is possible. See below;

Hello,
I am holding a valid H1-B visa which was stamped in 2007. But before i could make my travel plan i could see recession hitting US and people out of jobs. This made me to hold back my job at home instead of quitting in a hurry.
Now i am based in UK on an assignment and i would like to VISIT USA as a TOURIST for 4 weeks to see my brother.
1) Am i allowed to visit as a visitor ?
2) Can i still hold H1-b visa active without being cancelled ?
Anybody, please could you advise me how to go about.

My H1B expires in September and was filed under a different company name, but they are a successor in interest. so we were planning on amending the H1B when we file to extend. The problem now is - the beneficiary is in a new position AND as of September 1, 2009 the company has changed addresses.
A) In filling out the I-129 in Part 2, questions 2 and 5, what are the appropriate boxes to check?
I am afraid if we amend the current application, it won't also be extended and he will fall out of status.
part 2 Q 2asks " basic for classification" such as
1- new employment
2-continuance of previous approved employment
3-change in previously approved employment
4-new concurrent employment
5-change of employer
6- amended petition

I currently hold H4 visa. I got H1 approval (consular) this year. Now instead of applying by consular process (in London), I want to join my spouse on H4 and then apply for COS from within USA.
1. Can I do this?
2. If Yes, how? Which form do I have to fill ? Kindly detail the procedure with applicable costs.
3. When I later, travel outside US, do I then have to have H1 visa stamped in my passport?
4. If Yes, does this 1st visa have to be from home country or could be from Canada etc.?
P.S. I do not have any educational or work background in USA.

I have no LUD at all for my 1-140 which was approved 6 months back. The status message still stays "...processing..." !!

Hi all,
I am an American and my wife is going though the green card application process. We recently received our interview date. Unfortunately, it was scheduled one day prior to our wedding ceremony which is out of the country. Our wedding is being presided over by the mayor of a fairly large city, with like 300 or so guests and at this point would be impossible to change. At the same time I hear that mixing international travel and rescheduling green card interviews is a risky thing.
We have an infopass scheduled in two weeks, and beyond the supporting documents of our flight and wedding information, is there anything else we should bring to prove that we can't possibly be at this interview? Is this something a lawyer might be able to handle better (like have more credibility)?
Anyone willing to give odds on us successfully changing our interview date?

You should bring evidence of your strong ties to the country where you live now - evidence of a job, family, house, club memberships, bank accounts, etc. Anything you can think of that would show an immigration officer that you really intend to return home at the end of this trip.

I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.
Question is: Is there any deadline for them to complete processing all cases???

I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.
