I agree with you 100%
If we have filed our cases earlier - We have every right according to me to get our cases approved before others.. If they leave status current till everyone labors are approved (According to backlog center Sep 30 07) - That would resolve the issue/confusion.
If a clause exisits for us mentioning our 140/485 would be accepted next month would resolve the issue - any thoughts!!!

Because of the retrogression, I am investing all my money in India rather than in America where the growth is higher and more certainity for me atleast for time being...

All,
I visited the local office at Waukegan (Chicago suburb) last week to apply for SSN for my wife (H1 & EAD) and my minor son (H4) and was surprised to see SSN card in my mail box today for both of them!! :) (frankly I was expecting to see a denial letter for my son). Sequence of events
Me: submitted SSN form, passport for my minor Son
SSN officer: Upon seeing the visa. We do not accept application for h4 w/o work authorization
Me: I produced the printout of SSN provision 20 C.F.R. � 422.104(a)(3) and informed here that I need to apply for Federal benefit (stimulus package) and for that I would need one
SSN Officer: Oh yea..Oh yea.. there is a provision and she accepted the application
My sons SSN card displays "Not authorized to work".Thanks to Totoro posting the information on 05/03/2008.

Thank you for contacting me about my views on the current immigration proposals being considered by Congress.
I have long supported legislation to curb illegal immigration by increasing criminal penalties for immigrant smuggling and document fraud, eliminating the use of government documents that are easily forged, and doubling the number of border patrol guards. Better enforcement and tougher penalties for both undocumented immigrants and their lawbreaking employers are the way to fight unauthorized employment, and employment opportunities are what drive illegal immigration.
Unless we fix the North American Free Trade Agreement (NAFTA) and the Central American Free Trade Agreement (CAFTA) and enforce our own labor laws, we will continue to debate how high the fence should be and how many agents should guard our border � with no real solution in sight. In 1994, the U.S. signed NAFTA, which promised, among other things, to help create a thriving middle class in Mexico. At that time there were 3 million undocumented workers in the U.S.; today there are more than 11 million. In Mexico, 9 million more live in poverty than when NAFTA was enacted. NAFTA has failed the U.S. and Mexico. By creating an atmosphere where Mexican citizens feel they have no chance of a successful life in Mexico, these ill-conceived trade agreements increase the number of illegal immigrants coming into our country.
In addition to addressing the forces that are compelling illegal immigration, we must take action to bring illegal immigrants out of the shadows. While I do not support amnesty and have serious concerns about guest worker programs, I do believe our nation should consider establishing a process by which illegal immigrants can eventually earn citizenship. The solution to our immigration problem will not be a simple one, as many things in our country need to be fixed to stop illegal immigration. It is time to take a common sense approach to immigration reform.
The Senate most recently considered immigration when S.1639 was introduced in the 110th Congress. On June 28, 2007, the Senate rejected a cloture motion to proceed to final passage of S.1639 by a vote of 46 yeas to 53 nays. I was deeply concerned about the guest worker provisions in this bill, and voted against proceeding to a final vote. Should these issues come again before the Senate in the 111th Congress, I will be sure to keep your views in mind. Thank you again for contacting me.

Does this Bill and all associated Amendents get the new introduction date or it will basically take over from the Last Bill and Amedments. I am asking this question because last bill saying 140 after May 15 will be invalidated. Is thi still valid for this Bill? or they are gonna use tomorrow's date.

To the major headache we will be facing. Economy.
It is going to get nasty and there will be massive layoffs. We will have to hope for a quick recovery. Just today lehman, then washington mutual...who knows what is in store next. I heard that car companies are asking for bailouts. We got to end this war and spend the money here on improving the economy. All this money wasted in war is draining the economy...

buddy I dont know if you watched chris matthews last night interviewing many dems who won. Several mentioned immigration reform as part of their mandate
I watched msnbc throughout and every dem interviewed mentioned immigration reform. I do not think in public speeches Nancy and Hillary mentioned imm.
The thing is with the new majority, we should see some activity on imm as a whole.

I am amazed in the solidarity just by seeing the responses. But if i think deeper, this rally is not for some national cause or for some greater benefit.
Every single person here is doing this for one's own SELFISH reasons. Why then are we talking like we are marching to save the planet or save the poor animals going to slaughter or human trafficking or AIDS prevention or even the war in Iraq.
Yes, we make things easy for people down the road (however that is not our true intention, our true intention is just about how to get the card faster) but trying to pull in more people to the rally by playing on people's guilt is not the approach. You say it like you see it. We want people to come so I CAN GET MY GREEN CARD SOONER. Thats all. So everyone has the same motive...thats all. Nothing more or nothing less. Everyone is going for A SELFISH INTEREST...nothing based on higher principles of duty, sacrifice or to ensure higher morals of life. Everything is for sensual enjoyment.
Dont write like we are seeking independence or freedom.

Prince charming - I invoked AC21 sometime back after 180 days of filing 485 and moved to a new job on EAD.
My ex employer revoked 140. At this point of time I did a lot of research and found out the following things
(1) AC21 letter never reaches your file - there is no system in place for AC21 letter. G 28 gets into the system because there is a process in place for G 28
AC21 is a law that allows you to change jobs but there is no system in place.
(2) AC21 letter must be provided upon request - different officers want differtent information so they generally issue a NOID and ask you to submit evidence in 30 days. USCIS in some cases sends out straight denials. The denial letter generally has information to file MTR within 30 days if the case needs to be reopened due to USCIS error.
In August when my case was being processed, they sent me a NOID but sent my wife Fp notice - I called customer service and was advised that she can go for FP as usual but I have to respond to NOID before they move forward with my case and I promptly responded with AC21 and my case status changed to "Case reopened, response received" and there were soft LUDs hitting my 485.
Keep all documentation ready and be proactive, you can hire a good lawyer from MTR, remember that when you file for MTR, you cannot work - so before you inform your employer, get a letter from them and then inform them - in case employers will be reluctant to give any documentation if they know you cannot work for sometime. If you are on h1b you dont have to worry.
MTR approvals can take 3 to 5 weeks or more too.
if not on h1b you start accruing unlawful status and usually lawyers suggest that you stay till less than 180 days when your MTR is filed - it never takes 180 days for a decision on MTR so dont worry about unlawful status.
These are hidden risks in AC21 but good news is that AC21 cases have always been successful.
You may have to go through this period of uncertainity.

If your interpretation is correct, US STEM degree holders with 3-year experience hit the Jackpot. Good for them and good for remaining people in EB2 queue. Unfortunately EB3 can not use any surplus/leftover created in EB2 with the new bill. That is a minus point. EB-5 benefits a lot though.

Nope. Need 60 votes to do anything in Senate and that is why even though the Dems have a so called majority then cant get anything done.
However, you need 60 votes to end a fillibuster. A fillibuster is the method used by senators to stall a bill. They will force debate to continue indefinitely. To overcome the forced debate, you need 60 votes (which is what the cloture motion is).
To pass the bill, only 51 votes are needed. If there is a tie (50-50 or 49-49 or any valid combination), the the Vice President casts his vote to break the tie (and we all know on which side the VP is on)
